The short version

  • HomeWeek is a family planner: a shared calendar, chores, lists and more, shown on a shared screen and run from adults’ phones. It doesn’t supervise anyone, and it isn’t an emergency service. In an emergency in the U.S., call 911.
  • Accounts are only for adults in the United States. Children are added by a parent and may not have their own accounts. You are responsible for what your household puts in HomeWeek and for supervising children who use your shared screen.
  • Reminders, calendar copies and Smart Add suggestions can be late, missing or wrong. Check what matters.
  • HomeWeek is provided “as is,” our liability is limited, and you release certain claims against us. You also agree to cover claims by other people that come from your own choices, except where we are at fault.
  • If you live in the U.S., once you have agreed to these Terms in the app or in writing, disputes are resolved by individual arbitration, not class actions or jury trials, unless you opt out within 30 days. Small claims court is always an option.

This summary helps you read these Terms. It does not replace them.

IMPORTANT NOTICE ABOUT DISPUTES: IF YOU LIVE IN THE UNITED STATES, SECTION 20 REQUIRES YOU AND VANTARYN LABS TO RESOLVE MOST DISPUTES THROUGH BINDING INDIVIDUAL ARBITRATION RATHER THAN IN COURT, AND IT WAIVES YOUR RIGHT TO A JURY TRIAL AND TO TAKE PART IN A CLASS ACTION, ONCE IT APPLIES TO YOU AS SECTION 1 EXPLAINS. SMALL CLAIMS CASES ARE ALLOWED. YOU MAY OPT OUT OF ARBITRATION WITHIN 30 DAYS AS SECTION 20 EXPLAINS. SECTIONS 16 THROUGH 19 AND SECTION 22 ALSO LIMIT OUR LIABILITY, CONTAIN A RELEASE OF CLAIMS, AND LIMIT THE TIME YOU HAVE TO BRING A CLAIM.

1. About these Terms

These Terms of Use (“Terms”) are a legal agreement between you and Vantaryn Labs LLC (“Vantaryn Labs,” “we,” “us”), a Wyoming limited liability company. HomeWeek is a product of Vantaryn Labs. These Terms cover the HomeWeek app for iPhone and iPad and its widgets, the website at https://homeweek.app and the related services we provide (together, “HomeWeek”).

These Terms are also the end-user license agreement (EULA) for the HomeWeek app. Section 23 contains terms that Apple requires.

The following pages are part of these Terms and are incorporated by reference: Safety & Household Responsibility, which explains the limits of HomeWeek and what we ask households to do.

Our Privacy Policy explains how we collect, use and share information, including information about children. It is a notice of our practices and is not part of this contract.

How you accept. By creating an account, joining a household or using HomeWeek, you agree to these Terms to the extent the law allows. If you do not agree, do not use HomeWeek. Section 20 (arbitration and the class action waiver) applies to you only after you agree to these Terms in the app, when the app asks you to, or otherwise agree to them in writing, for example by email.

In these Terms, “you” means the adult who creates or joins a HomeWeek household. A “household” is the group of adults, children and shared screens that share one HomeWeek calendar. A “shared screen” is a device an adult pairs to show the household’s calendar, such as a kitchen iPad.

Your legal rights. Nothing in these Terms takes away any right you have under consumer protection or other laws that cannot be waived or limited by contract. Where a part of these Terms is not allowed by the law that applies to you, that part applies only to the extent the law allows.

2. Who may use HomeWeek

  • United States. We offer HomeWeek to households in the United States. To create or join a household, you must live in the United States. If you travel outside the United States, these Terms still apply, and some features may not work.
  • Adults only. To create an account, you must be at least 18 years old and have reached the age of majority where you live.
  • Children use HomeWeek through their household. Children may not create or use their own accounts and are not parties to these Terms. Information about a child is entered by an adult in the child’s household, and a child may use a shared screen only as the household’s adults allow and supervise. You may add a child to a household only if you are the child’s parent or legal guardian or have that parent’s or guardian’s permission.
  • Household use. HomeWeek is for personal, non-commercial household use. It is not for businesses, schools or other organizations.
  • Legal compliance. You must not be barred from using HomeWeek under U.S. law or any other law that applies to you, and you must meet the requirements in Section 23.

3. Your account, your household and shared screens

  • Accurate information. Give us accurate account information and keep your email address up to date, because we use it for important notices.
  • Keep credentials private. Keep your password, the codes we email you and pairing codes private. We never ask you to send us your password or a pairing code.
  • Activity on your account. You are responsible for activity under your account and on shared screens you pair, except to the extent it is caused by our breach of these Terms. If you think someone has used your account without permission, tell us promptly at hello@homeweek.app.
  • Roles. The adult who creates a household is its owner, until they hand ownership to another adult in the household. Owners and admins can invite adults, manage the household’s people and settings, pair or remove shared screens and export the household’s records. Every adult in a household sees the household’s items; an item marked Private is seen only by the adult who made it. Invite only adults you trust with your household’s information, and remove anyone who should no longer have access.
  • Shared screens. A shared screen shows the household’s items to anyone near it. You choose what each screen may do, such as ticking chores or editing lists, and you can remove it at any time in Settings > Devices & Shared iPad. Don’t put anything on the household calendar that you wouldn’t want people in that room to see; use Private or Busy only for that.

4. What HomeWeek is and is not

HomeWeek is software that helps a household keep a shared calendar and plan its week: events, reminders, chores, routines, lists, meals, notes, a photo frame and Smart Add, which suggests events from photos and sentences.

HomeWeek is not:

  • A supervisor. It is not a babysitter or a substitute for an adult’s attention and judgment.
  • An emergency service. It is not a safety, emergency or crisis service. If anyone is in danger in the U.S., call 911 (elsewhere, call your local emergency number). For a mental-health crisis in the U.S., call or text 988.
  • A guaranteed reminder service. Reminders and alerts can be late, missed or turned off by your device’s settings. Don’t rely on HomeWeek alone for anything important, such as medicine, pickups or appointments.
  • Professional advice. Nothing in HomeWeek, including chores, routines, rewards, meals or recipes, is medical, nutritional, developmental or other professional advice.
  • A backup service. Past items are cleared on the schedule your household chooses. Keep your own copies of anything you need.
  • A weather service. Weather comes from Open-Meteo and can be wrong or unavailable.

5. Household responsibility

You are responsible for your household’s use of HomeWeek, including:

  • what you and the adults you invite put in HomeWeek, including information about children and other people;
  • supervising children who use a shared screen, and choosing what that screen may do;
  • the chores, routines and rewards you set, and how they are supervised (Section 6);
  • checking important dates, times and places, especially ones that came from Smart Add;
  • who can see your shared screens; and
  • following the laws that apply to you.

No transfer of your duties. HomeWeek is a tool you use. By offering HomeWeek and its features, warnings and tips, we do not take on, share or replace any duty that you or any other adult owes to a child or anyone else, including the duty to supervise, and we do not undertake to protect anyone from harm. Please read Safety & Household Responsibility. Its description of what HomeWeek can and cannot do is part of these Terms.

6. Chores, routines and rewards

You create every chore, routine and reward in HomeWeek. You are responsible for making sure each one is safe, lawful, suitable for the person’s age and abilities, and properly supervised. Chores are family activities, not employment, and HomeWeek does not pay anyone.

Points and rewards in HomeWeek are a way to keep track within your household. They have no cash value, are not money or property, cannot be sold, transferred or redeemed with us or anyone else, may be corrected if they result from an error, and end if the household is deleted. Any real-world reward you promise is an arrangement within your household; we don’t provide or pay for it.

To the extent the law allows, we are not responsible for injury, loss or damage arising from any chore, routine, activity or reward that an adult chooses, assigns, supervises or fails to supervise.

7. Smart Add

Smart Add suggests events and tasks from photos, scans, typed sentences and speech. Suggestions are automated guesses. They can miss things, misread handwriting, get dates, times or names wrong, or include things that aren’t there. You check each suggestion before it is saved, and you are responsible for what you save.

Only send Smart Add photos and text you have the right to use. Avoid sending other people’s private information that your household doesn’t need.

8. Your content

“Your content” means the information and material that you and your household put in HomeWeek, such as events, chores, lists, notes, drawings, photos, files, names and settings.

  • You keep ownership. You and your household keep any rights you have in your content.
  • Our limited license. You grant Vantaryn Labs a non-exclusive, worldwide, royalty-free license to host, store, copy, process, transmit and display your content only as needed to operate, provide, secure and support HomeWeek for your household, to comply with the law and to enforce these Terms. We don’t use your content for advertising or to train AI models, and we don’t sell it. This license ends when your content is deleted from our systems, except for copies other members of your household already have and copies we keep as our Privacy Policy describes.
  • Your promises. You confirm that you have the rights needed to put your content in HomeWeek and that it doesn’t break these Terms or the law.
  • Removal. We may remove content or limit features if we reasonably believe content breaks these Terms or the law, but we have no duty to monitor content.
  • Keep your own copies. HomeWeek clears past items on your household’s schedule and is not a backup service. Owners and admins can export the household’s records from the app.

9. Content rules and acceptable use

You agree not to do, and not to help or allow anyone else to do, any of the following:

  • put content in HomeWeek that is unlawful, that sexualizes or exploits a child, that threatens, harasses or demeans anyone, or that shares another person’s private information or images without the right to do so;
  • use HomeWeek to track, monitor or watch any person without legal authority;
  • access another household’s information, or try to gain unauthorized access to HomeWeek or our systems;
  • copy, modify, reverse engineer, decompile or disassemble the app, except where the law expressly allows it despite this restriction;
  • interfere with, overload or disrupt HomeWeek, including with bots, scripts or scraping;
  • get around any security measure, rate limit or usage limit;
  • sell, resell, rent, lend or sublicense HomeWeek or access to a household; or
  • use HomeWeek in a way that breaks the law, violates anyone’s rights or breaks Apple’s terms.

As the law requires, we report apparent child sexual exploitation to the National Center for Missing & Exploited Children. If you find a security problem, please report it to hello@homeweek.app and don’t access other people’s information.

10. Privacy and children’s information

Our Privacy Policy explains what information we collect, how we use and share it, how long we keep it and your choices, including a Children’s information section. HomeWeek is not directed to children, and accounts are only for adults. By adding information about a child, you confirm that you are allowed to share it, as Section 2 explains.

You can ask us to delete your account or household by emailing hello@homeweek.app.

11. License and intellectual property

Your license to use the app

Subject to these Terms, Vantaryn Labs grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install and use the HomeWeek app on Apple-branded iPhone and iPad devices that you own or control, and to let the adults and shared screens in your household use it, as permitted by the Usage Rules in Apple’s Media Services Terms and Conditions, solely for personal, non-commercial household use. The app may also be used by other accounts associated with you through Apple’s Family Sharing, as Apple’s Usage Rules permit.

Our ownership

HomeWeek, including the app, websites, software, artwork and design, and the HomeWeek name and logo, is owned by Vantaryn Labs or its licensors and is protected by intellectual property laws. We keep all rights not expressly granted in these Terms. You may not use our names, logos or trademarks without our written permission.

Open-source components

Some parts of the app, such as certain software libraries, are provided under open-source licenses. Those licenses govern those parts, and nothing in these Terms limits the rights they give you. Copies of the required notices are included with the app or available from us on request.

Updates

We may provide updates to the app. Some updates may be needed to keep using HomeWeek or certain features. These Terms apply to all updates.

12. Feedback

We welcome ideas and suggestions. If you send us feedback, you grant Vantaryn Labs a non-exclusive, perpetual, irrevocable, worldwide, royalty-free license to use it for any purpose, without payment or any obligation to you. You keep any other rights you have in it. Please don’t include private information about your household in feedback. Nothing in these Terms limits your right to post an honest review of HomeWeek.

13. Third-party services

HomeWeek relies on services provided by others, including Apple (the App Store and features that run on your device), Supabase (hosting, database, storage and sign-in), Open-Meteo (weather) and Google Workspace (our support mailbox). How we share information with them is described in our Privacy Policy.

These services are outside our control. To the extent the law allows, we are not responsible for their acts, omissions, outages or changes. Your use of another company’s service is governed by that company’s terms. Links to other websites are provided for convenience, and we are not responsible for their content.

14. Changes to HomeWeek

We may change, add or remove features and supported devices or operating system versions, and we may suspend or discontinue HomeWeek or any part of it. Other companies may also change their services in ways that affect HomeWeek.

15. Ending your use, suspension and termination

You can stop at any time

You can stop using HomeWeek at any time. You can leave a household or remove a shared screen in the app, and you can ask us to delete your account or household by emailing hello@homeweek.app.

When we may suspend or terminate

We may suspend or end your access or your household’s access, or remove content, if you materially or repeatedly break these Terms, if the law or a valid legal request requires it, if your use creates a risk of harm or legal exposure for anyone, or if we discontinue HomeWeek. Where reasonable and lawful, we will tell you first and give you a chance to fix the problem.

What happens next

When your access ends, your license to use HomeWeek ends. This does not limit any right you have under applicable law. Sections 4 through 6, 8, 11 through 13, and 16 through 26, and any other terms that by their nature should survive, continue to apply.

16. Disclaimer of warranties

HOMEWEEK IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS. TO THE FULLEST EXTENT PERMITTED BY LAW, VANTARYN LABS AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS AND SERVICE PROVIDERS DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY AND QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WITHOUT LIMITING THE ABOVE, WE DO NOT WARRANT THAT: (A) REMINDERS, ALERTS OR CALENDAR COPIES WILL ARRIVE, WILL ARRIVE ON TIME OR WILL BE COMPLETE; (B) SMART ADD SUGGESTIONS, WEATHER OR ANYTHING ELSE HOMEWEEK SHOWS WILL BE ACCURATE; (C) HOMEWEEK WILL KEEP ANYONE SAFE OR SUPERVISED; OR (D) HOMEWEEK WILL BE UNINTERRUPTED, SECURE, ERROR-FREE OR FREE OF HARMFUL COMPONENTS, OR THAT DATA WILL NOT BE LOST.

Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you. Where an implied warranty cannot be excluded, it is limited to the shortest period the law allows. Nothing in this section affects any warranty or right that cannot be excluded or limited under the law that applies to you. Section 23 explains Apple’s role in warranty matters.

17. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL VANTARYN LABS OR ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR USE, ARISING OUT OF OR RELATING TO THESE TERMS OR HOMEWEEK, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN TOLD THAT SUCH DAMAGES ARE POSSIBLE.

TO THE FULLEST EXTENT PERMITTED BY LAW, AND WHETHER OR NOT THE CLAIM ALLEGES THAT WE WERE NEGLIGENT, WE ARE NOT LIABLE FOR DAMAGES ARISING FROM: A MISSED, LATE OR WRONG REMINDER, EVENT, CALENDAR COPY, SMART ADD SUGGESTION OR WEATHER FORECAST; ANY PERSON’S SUPERVISION OR LACK OF SUPERVISION OF A CHILD; CHORES, ROUTINES, ACTIVITIES OR REWARDS CHOSEN BY AN ADULT; WHAT ANYONE SEES ON A SHARED SCREEN; THE CONDUCT OF ANY USER OR THIRD PARTY; OR THE PRODUCTS OR SERVICES OF APPLE OR ANY OTHER THIRD PARTY.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR HOMEWEEK WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR HOMEWEEK, INCLUDING PURCHASES THROUGH APPLE, IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) US$50.

These limits apply even if a limited remedy fails of its essential purpose. They are an essential part of our agreement. Nothing in these Terms limits or excludes liability for our gross negligence, recklessness, fraud, or willful or wanton misconduct, for death or personal injury caused by our negligence where the law does not allow that liability to be limited, or for any other liability that cannot be limited or excluded under the law that applies to you. Where that law does not allow a limit in this section, the limit applies to the fullest extent that law allows. This section applies to a claim that belongs to a child only as Section 19 describes, and to New Jersey residents as Section 25 explains.

18. Indemnification

To the fullest extent permitted by law, you will defend (at our option), indemnify and hold harmless Vantaryn Labs and its members, managers, employees, contractors, agents, licensors and service providers (the “Vantaryn Labs Parties”) from and against all claims and demands made by anyone other than you or us, and all resulting losses, liabilities, damages, judgments, settlements, costs and expenses, including reasonable legal fees, to the extent they arise out of or relate to:

  • your use of HomeWeek, and use by the people and shared screens in your household;
  • the chores, routines, activities and rewards that you choose, assign, supervise or fail to supervise;
  • content that you or your household put in HomeWeek;
  • your breach of these Terms; or
  • your violation of any law or of anyone’s rights.

You do not have to indemnify a Vantaryn Labs Party to the extent a claim results from our negligence, gross negligence, recklessness, fraud, willful misconduct or breach of these Terms. This section covers claims made by other people. It does not apply to a dispute between you and us, which Section 20 governs. It covers a claim made by or on behalf of a child only to the extent the claim arises from your own acts or omissions, and only where the law of the state where the child lives allows a parent to agree to it; it does not apply to New Jersey residents (Section 25). We will tell you about a claim we ask you to cover, and you may not settle it in a way that imposes any obligation on, or admits fault by, a Vantaryn Labs Party without our written consent.

19. Assumption of risk and release

THIS SECTION CONTAINS A RELEASE. YOU GIVE UP CERTAIN CLAIMS AGAINST US, INCLUDING CLAIMS YOU DO NOT YET KNOW ABOUT AND CLAIMS BASED ON OUR ORDINARY NEGLIGENCE, TO THE EXTENT THE LAW ALLOWS. IT DOES NOT COVER OUR GROSS NEGLIGENCE, RECKLESSNESS, FRAUD, OR WILLFUL OR WANTON MISCONDUCT. PLEASE READ IT CAREFULLY.

Risks you accept

Some risks come with any planning tool and remain even when we use reasonable care. Reminders and alerts can be late or missed. Calendar copies, Smart Add suggestions and weather can be late, incomplete or wrong. Anyone near a shared screen can see what it shows. Chores and other activities can involve physical risk. You choose to use HomeWeek knowing this and, to the extent the law allows, you assume these risks.

Your release

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU, AND ANYONE CLAIMING THROUGH YOU, RELEASE THE VANTARYN LABS PARTIES FROM ALL CLAIMS, DEMANDS AND DAMAGES, KNOWN AND UNKNOWN, INCLUDING CLAIMS BASED ON THE ORDINARY NEGLIGENCE OF A VANTARYN LABS PARTY, ARISING OUT OF OR RELATING TO: (A) THE ACTS OR OMISSIONS OF ANY ADULT, CHILD, HOUSEHOLD MEMBER OR OTHER USER; (B) CHORES, ROUTINES, ACTIVITIES OR REWARDS CHOSEN, ASSIGNED OR SUPERVISED BY AN ADULT; (C) A MISSED, LATE OR WRONG REMINDER, EVENT, CALENDAR COPY, SMART ADD SUGGESTION OR WEATHER FORECAST; AND (D) THE PRODUCTS OR SERVICES OF APPLE OR ANY OTHER THIRD PARTY. THIS RELEASE INCLUDES YOUR OWN CLAIMS THAT COME FROM AN INJURY TO YOUR CHILD, SUCH AS CLAIMS FOR YOUR CHILD’S MEDICAL EXPENSES.

A child’s own claims

A claim that belongs to a child is the child’s claim, not yours. Where the law of the state where the child lives allows a parent to release a child’s claims in advance, you also give this release on your child’s behalf, as the child’s parent or legal guardian, and Section 17 applies to your child’s claims. Where that law does not allow it, this section and Section 17 do not release or limit your child’s own claims, but your own claims stay released and limited.

What this section does not cover

This section does not release any claim arising from our gross negligence, recklessness, fraud, or willful or wanton misconduct; any claim for death or personal injury caused by our negligence where the law that applies does not allow it to be released; or any other claim that cannot be released under the law that applies to you.

California residents

If you are a California resident, you waive California Civil Code Section 1542 for the claims released in this section. Section 1542 says: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.” You also waive any similar law in any other jurisdiction, to the extent a waiver is allowed.

20. Dispute resolution and arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT, TO HAVE A JURY HEAR YOUR CLAIMS, AND TO TAKE PART IN A CLASS ACTION.

When this section applies

This section applies to you once you have agreed to these Terms in the app or otherwise in writing, as Section 1 explains. Until then, the informal resolution process below still applies, and a dispute that isn’t resolved goes to the courts described in Section 21.

Informal resolution first

Most concerns can be solved quickly by contacting us at hello@homeweek.app. Before either of us starts an arbitration or a small claims case, the person with the claim must send the other a written notice of dispute, and we will both try in good faith to resolve it informally for 60 days after the notice is received.

  • Notice to us must be sent by email to hello@homeweek.app with the subject line “Notice of Dispute.” You may also mail a copy to Vantaryn Labs LLC, 30 N Gould St #69108, Sheridan, WY 82801, United States.
  • Notice to you will be sent to the email address on your HomeWeek account.
  • Your notice must include your name, the email address on your account, a description of the dispute and the relief you want, and must be personally signed by you (and by your legal representative, if you have one). A typed or electronic signature is enough. Our notice will include the same information about our claim.
  • If either of us asks, we will meet by phone or video for an individual settlement conference during the 60 days, at a time that works for both of us. You must attend personally, and your legal representative may also attend. A representative of Vantaryn Labs who can settle the dispute will attend for us.

This process is required before starting arbitration or a small claims case. Any time limit for bringing the claim, and any filing fee deadline, is paused while this process is underway.

Agreement to arbitrate

You and Vantaryn Labs agree that any dispute, claim or controversy arising out of or relating to these Terms, HomeWeek, your account, your household, any purchase, our communications with you, or our handling of information, whether based on contract, tort, statute, fraud or any other legal theory, and whether it arose before or after you agreed to these Terms, except a lawsuit or arbitration that was already pending when you first agreed to them (a “Dispute”), will be resolved by binding individual arbitration, except as stated under “Exceptions” below. This includes Disputes you bring on behalf of your child, to the fullest extent permitted by law.

Children’s claims. A Dispute that belongs to a child is brought for the child by a parent, legal guardian or court-appointed representative. In an arbitration of a child’s Dispute: (a) either of us may ask a court to appoint a guardian ad litem, and the arbitrator will pause the arbitration while that request is pending; (b) any settlement will be submitted to a court for approval where the law of the state where the child lives requires court approval of a minor’s settlement, and any award will be paid as that law requires; and (c) the arbitrator will apply the protections for minors that a court in that state would apply. If a court decides that a child’s Dispute cannot be sent to arbitration, that Dispute will be decided in court under Section 21, and this section still applies to every other Dispute and person.

The arbitrator decides all questions about the scope, validity, enforceability and arbitrability of this section, except that a court decides (a) whether the class action and jury trial waiver and the severability paragraph below are valid and enforceable and how they apply, and (b) whether a claim falls within the exceptions below. Disagreements about the mass arbitration paragraph are decided as that paragraph states. The Federal Arbitration Act governs this section.

Exceptions

  • Small claims. You may bring an individual claim in small claims court in the county where you live or in Sheridan County, Wyoming. We may bring an individual claim against you in small claims court only in the county where you live. The claim must qualify for that court and stay there on an individual basis.
  • Intellectual property. Either of us may ask a court to stop the infringement or misuse of intellectual property rights.
  • Government agencies. Nothing in this section stops you from bringing a concern to the attention of a government agency.

Rules and administrator

The arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules in effect when the arbitration is filed and, for a Mass Filing (defined below), its Mass Arbitration Supplementary Rules, each as changed by this section. The rules and fee schedules are available at www.adr.org. We will pay any fee the AAA charges to review this arbitration agreement. If the AAA decides that any part of this section does not meet its Consumer Due Process Protocol, that part will not apply to that arbitration, and the rest of this section still applies. If the AAA is unable or unwilling to administer the arbitration for any reason other than our failure to pay fees we owe, you and we will choose another provider together; if we cannot agree within 30 days, either of us may ask a court to appoint one under Section 5 of the Federal Arbitration Act. Any other provider must follow this section, including its fee terms. The arbitration will be decided by a single arbitrator and conducted in English.

Hearings and the decision

If no claim or counterclaim is for more than $25,000, the arbitration will be decided on written submissions unless a party asks for a hearing or the arbitrator decides one is needed. Any hearing will be held by video conference or, if you prefer to meet in person, in the county where you live, unless we both agree otherwise. The arbitrator may award, on an individual basis, any relief a court could award, but only in favor of the individual party seeking relief and only to the extent needed to resolve that party’s individual claim. The arbitrator must follow these Terms and applicable law and will issue a written decision explaining the essential findings. The award is final and binding, subject to review under the Federal Arbitration Act, and judgment on it may be entered in any court with jurisdiction. An award does not bind anyone who was not a party to that arbitration.

Fees and costs

For an arbitration you start, your share of the filing fee will be no more than the lesser of the amount allowed under the AAA Consumer Arbitration Rules and the filing fee you would pay to bring the claim in court. We will pay all other AAA filing, administrative and arbitrator fees. If the arbitrator finds that your claim was frivolous or brought for an improper purpose, as measured by Federal Rule of Civil Procedure 11(b), the AAA rules govern who pays those fees. Each side pays its own legal fees and costs unless the arbitrator awards them under applicable law. We will not seek our legal fees from you unless the arbitrator finds your claim frivolous. Unless the law requires a different time, any invoice that the arbitration provider sends to either of us after a demand for arbitration has been filed is due 30 days after the provider sends it. The AAA may also reduce or waive your fees if you cannot afford them.

Class action and jury trial waiver

YOU AND VANTARYN LABS EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. UNLESS YOU AND WE BOTH AGREE, THE ARBITRATOR MAY NOT COMBINE MORE THAN ONE PERSON’S CLAIMS OR PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING, EXCEPT FOR THE ADMINISTRATIVE BATCHING DESCRIBED BELOW, IN WHICH EACH CLAIM IS STILL DECIDED INDIVIDUALLY. IF A DISPUTE IS DECIDED IN COURT RATHER THAN IN ARBITRATION, YOU AND VANTARYN LABS EACH WAIVE THE RIGHT TO A JURY TRIAL, TO THE EXTENT THE LAW ALLOWS.

Mass arbitration

If 25 or more demands for arbitration raising the same or substantially similar claims are filed against us, or by us, and the claimants or their representatives are the same or are coordinating with each other (a “Mass Filing”), the AAA’s Mass Arbitration Supplementary Rules and its fee schedule for consumer mass arbitrations apply, together with the following:

  • Each claimant must first complete the informal resolution process individually.
  • The demands will be administered in batches of up to 50, with any remainder in a final batch. One arbitrator will handle each batch, and all batches will go forward at the same time.
  • Each claim is decided individually, on its own facts, evidence and law. No claim is held back to wait for another, and a decision on one claim does not bind any other claimant.
  • Each claimant keeps every right this section gives, including its fee and hearing terms and the right to be represented by counsel of their choice.
  • For each claim in a Mass Filing, any time limit for bringing the claim is paused from the date the claimant sent a complete notice of dispute until the claim is assigned to a batch.
  • A disagreement about whether or how this paragraph applies will be decided by the process arbitrator appointed under the AAA’s Mass Arbitration Supplementary Rules. If this paragraph cannot be enforced for a Mass Filing, those claims will proceed in individual arbitration under the AAA’s rules for mass arbitration then in effect.

Opting out within 30 days

You may opt out of this section by emailing hello@homeweek.app within 30 days after the date you first agree to these Terms in the app or in writing. Use the subject line “Arbitration Opt-Out” and include your full name, the email address on your HomeWeek account, and a clear statement that you want to opt out of arbitration. If you opt out, Disputes between you and us will be decided in court under Section 21, and the rest of these Terms still apply. Your opt-out also applies to later versions of these Terms. It applies only to you, including claims you bring on behalf of your children, and not to any other adult in your household, who may opt out separately.

Changes to this section

If we make a material change to this section after you have agreed to it (other than a change to our contact information), you may reject the change by emailing hello@homeweek.app within 30 days after the change takes effect, with the subject line “Reject Arbitration Changes.” If you reject it, the most recent version of this section that you agreed to continues to apply. Whether or not you reject it, a change never applies to a Dispute that arose, that either of us had given notice of, or that was pending in arbitration or court before the change took effect.

Severability

If the class action waiver is found unenforceable for any claim or form of relief, that claim or relief, and only that, will be separated from the arbitration and decided by a court under Section 21, after the individual arbitration is finished. If you seek public injunctive relief and a court decides that the claim cannot be waived or arbitrated under applicable law, that claim will be decided by a court after the individual claims are arbitrated. If any other part of this section is found unenforceable, the rest of it still applies. Class, collective or representative arbitration is never permitted under these Terms.

If you live outside the United States

If you live outside the United States, this section does not apply to you except for the informal resolution process, and a Dispute that is not resolved informally will be decided by the courts described in Section 21, unless the law where you live gives you a right that cannot be waived by agreement to bring it in your local courts.

21. Governing law and venue

These Terms and any Dispute are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules, and by applicable U.S. federal law. The Federal Arbitration Act (9 U.S.C. § 1 and following) governs the interpretation and enforcement of Section 20. The United Nations Convention on Contracts for the International Sale of Goods does not apply. If the consumer protection laws of the place where you live give you rights that cannot be changed by agreement, those laws continue to apply to you.

For any Dispute that is not arbitrated, other than a small claims case, you and Vantaryn Labs agree to the exclusive jurisdiction and venue of the state courts located in Sheridan County, Wyoming, and the United States District Court for the District of Wyoming, and waive any objection that those courts are an inconvenient forum. This does not apply where the law of the place where you live gives you a right that cannot be waived by agreement to bring the Dispute in your local courts. Either of us may ask any court with jurisdiction to enforce an arbitration award.

22. Time limit to bring a claim

To the extent permitted by law, any claim arising out of or relating to these Terms or HomeWeek must be started, in arbitration, in small claims court, or in court where Section 20 does not apply, within one year after the person bringing the claim knew, or reasonably should have known, of the facts giving rise to it. Otherwise, the claim is permanently barred. If the law that applies to the claim does not allow this time limit, or gives a longer time that cannot be shortened by agreement (for example, for certain claims under consumer protection statutes, or while a child who has a claim is still a minor), the shortest time limit that law allows applies instead. The time limit is paused while the informal resolution process in Section 20 is underway and as that section states for a Mass Filing. This section is not part of the arbitration agreement; if it cannot be enforced for any claim, that does not affect Section 20 or any other part of these Terms.

23. Apple App Store terms

This section applies to the HomeWeek app you download from Apple’s App Store. It is part of these Terms and controls if it conflicts with any other part of these Terms. You and Vantaryn Labs acknowledge and agree to each of the following terms.

Acknowledgment

These Terms are between you and Vantaryn Labs only, not Apple Inc. (“Apple”). Vantaryn Labs, not Apple, is solely responsible for the app and its content. Nothing in these Terms is meant to conflict with the Usage Rules in Apple’s Media Services Terms and Conditions; if there is a conflict about your license to use the app, those Usage Rules control.

Scope of license

Your license to use the app is the limited, non-transferable license described in Section 11, for use on Apple-branded products that you own or control, as permitted by Apple’s Usage Rules, except that the app may also be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.

Maintenance and support

Vantaryn Labs is solely responsible for providing any maintenance and support for the app, as stated in these Terms or as required by law. Apple has no obligation whatsoever to provide any maintenance or support for the app.

Warranty

Vantaryn Labs is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app, if any, to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are Vantaryn Labs’ sole responsibility.

Product claims

Vantaryn Labs, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession or use of it, including: (a) product liability claims; (b) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy or similar laws. These Terms do not limit Vantaryn Labs’ liability to you beyond what applicable law permits.

Intellectual property claims

If a third party claims that the app, or your possession and use of it, infringes that third party’s intellectual property rights, Vantaryn Labs, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.

Legal compliance

You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties. You will not use, export or re-export HomeWeek in violation of U.S. export control or sanctions laws or the laws of the place where you obtained it.

Developer name and address

Please send questions, complaints or claims about the app to Vantaryn Labs LLC, 30 N Gould St #69108, Sheridan, WY 82801, United States; hello@homeweek.app; (307) 393-5609.

Third-party terms

When you use the app, you must follow any applicable third-party terms of agreement, such as your wireless carrier’s terms and Apple’s terms for your Apple Account.

Third-party beneficiary

You and Vantaryn Labs acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and that, when you accept these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

24. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes to HomeWeek or to the law. We will post the updated Terms on this page and change the “Last updated” date. If a change is material, we will notify you in the app or by email at least 30 days before it takes effect, unless the change is required sooner by law or is needed to address a security or safety issue, in which case we will notify you as soon as reasonably practical. Where the law requires it, or where we choose, we will ask you to accept the updated Terms in the app.

If you keep using HomeWeek after updated Terms take effect, you accept them. If you don’t agree, stop using HomeWeek. Updates do not apply retroactively. Section 20 governs changes to the arbitration agreement.

We keep each version of this page at its own permanent web address, so you can always see the version you agreed to. This version is at https://homeweek.app/terms/2026-11-03/.

25. General provisions

  • Entire agreement. These Terms, including the pages incorporated by reference in Section 1 and any additional terms shown in the app for a particular feature, are the entire agreement between you and Vantaryn Labs about HomeWeek and replace any earlier agreements about it. If these Terms conflict with a page incorporated by reference, these Terms control.
  • Severability. If any part of these Terms is found unenforceable, that part will be changed only as much as needed to make it enforceable, and the rest of these Terms stays in effect. Sections 16 through 19 are separate and independent; if any of them, or any part of one, cannot be enforced against a particular person or for a particular claim, such as a claim that belongs to a child, it still applies to every other person and claim. Section 20 has its own severability terms.
  • No waiver. If we don’t enforce a part of these Terms, that is not a waiver of our right to enforce it later.
  • Assignment. You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms in connection with a merger, acquisition, reorganization or sale of assets, or by operation of law, with notice to you where the law requires it.
  • Events beyond our control. We are not responsible for any delay or failure caused by events beyond our reasonable control, including natural disasters, pandemics, war, terrorism, civil unrest, labor disputes, government action, power or internet failures, cyberattacks, and outages or changes in Apple’s platforms or our service providers’ systems.
  • Notices. We may send you notices by email to your account email address, in the app, or on this website. Send notices to us at hello@homeweek.app. Other legal notices to us must be sent by email and also mailed to our address in Section 26.
  • Electronic communications. You agree that we may give you agreements, notices, disclosures and other communications electronically, by email to your account email address or in the app, and that these satisfy any legal requirement that a communication be in writing. To receive them, you need a device that can run HomeWeek or open web pages, and an email account you can check. You may ask for a free paper copy of any notice we must give you by emailing hello@homeweek.app with your mailing address. You may withdraw this consent at any time, without charge, by emailing us with the subject line “Paper notices”; we will then mail the notices the law requires, and your account will keep working.
  • Relationship. You and Vantaryn Labs are independent parties. These Terms do not create a partnership, joint venture, agency or employment relationship.
  • Third-party beneficiaries. There are no third-party beneficiaries of these Terms other than Apple and its subsidiaries (Section 23) and the Vantaryn Labs Parties (Sections 16 through 19).
  • Interpretation. Headings and the summary at the top of this page are for convenience only. “Including” means “including without limitation.”
  • Language. If we provide a translation of these Terms, the English version controls.
  • New Jersey residents. If you or your child live in New Jersey: (a) Sections 6, 17, 18, 19 and 22 do not release, limit, cap or shorten the time to bring any claim that belongs to your child, and Section 18 does not require you to indemnify us against any claim made by or on behalf of your child; your child’s claims can still be required to go to individual arbitration under Section 20 once it applies; (b) Sections 17, 18 and 22 do not limit any damages, legal fees, costs or time to bring a claim that you have under the New Jersey Consumer Fraud Act or the Truth-in-Consumer Contract, Warranty and Notice Act; and (c) Section 17 does not exclude punitive damages that New Jersey’s Punitive Damages Act allows. Every other provision of these Terms applies to New Jersey residents as written.
  • California users. Under California Civil Code Section 1789.3, California users are entitled to the following notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
